Tektolo Terms of Use

These terms cover your use of the Tektolo website, web tool, REST API and MCP endpoint (together, the "Service"). The Service is operated by Corey Kozak, an individual in North Carolina, USA ("we", "us"). Tektolo is a working name.
1. Acceptance
By using the Service you agree to these terms and to our Privacy Policy and Estimates, safety and responsibility disclaimer. If you do not agree, do not use the Service. You must be at least 18, or the age of majority where you live, and able to form a binding agreement. If you use the Service for a business, you agree on its behalf.
2. What the Service does
The Service takes property-turnover findings that you (or an AI assistant acting for you) submit, and returns an estimate range of tasks and costs, with stated assumptions, unknowns and referrals. It is free, needs no account and takes no payments. We may add accounts or paid features later; these terms will be updated first.
3. Estimates are not quotes, and not advice
- Outputs are estimate ranges for planning. They are not quotes, bids, appraisals, inspections or offers. Actual prices depend on the vendor, local market, access and the real condition of the property.
- Outputs are not legal, financial, engineering, safety or other professional advice. Labels such as "normal wear" or "likely damage" are hints, not legal determinations. Security-deposit and tenant-charge rules vary by state and locality; check the law that applies to you or ask a qualified professional.
- Regional cost adjustments use public wage data and general price guidance. They can be wrong for your market.
- Review every output before you rely on it, send it to a vendor, or charge anyone based on it.
4. Safety and referrals
The Service organizes and prices routine make-ready work. It does not diagnose structural, electrical, gas, mold, asbestos, lead-paint or other health and safety hazards. When a finding suggests one, the Service flags it for a licensed professional and shows any placeholder amount as "quote required". Absence of a flag does not mean a hazard is absent. If you smell gas, see exposed wiring, or suspect a danger to anyone, stop and contact the appropriate professional or emergency services. You are responsible for compliance with all laws that apply to your property, including lead-safe work rules and tenant notice requirements.
5. Permitted use and limits
You may use the Service for lawful purposes, including in your business. You may not:
- attack, probe, overload or try to break the Service or its security, or evade rate limits;
- scrape or bulk-harvest the Service beyond the published limits or in ways that degrade it for others;
- submit unlawful content, malware, or personal data of other people that you have no right to share (the tool needs a ZIP code, not an address or names);
- present outputs as a professional inspection, licensed assessment, binding quote or legal advice, or otherwise misrepresent them;
- resell raw access to the Service as your own API, or use the Service to build a competing service from its rules data, without our written permission.
Current limits (which may change): request bodies up to 256 KB, up to 200 findings per request, about 30 requests per minute per client, and a tighter limit for downloadable files. Exceeding limits returns an error. We may throttle or block traffic that harms the Service.
6. API and MCP use, including by AI agents
You may call the REST API and MCP endpoint directly or through an AI assistant. If an AI agent or other automated tool calls the Service on your behalf, you are responsible for its use, including what it submits and how its results are presented or acted on. AI assistants can misread inputs or summarize outputs incorrectly; check the underlying result, especially refer-outs, assumptions and totals. If you build a product or integration on the Service, you must pass on the estimates-not-quotes and safety messages to your own users.
7. Intellectual property
The Service, website, rules data, engine and documentation belong to us or our licensors and are protected by law. We grant you a limited, non-exclusive, revocable license to use the Service under these terms. Fonts are used under the SIL Open Font License. Third-party data and guidance (for example U.S. Bureau of Labor Statistics wage data, and U.S. HUD and EPA public guidance, and cited publications) are credited to their sources, and their names and trademarks belong to their owners; their use here does not imply endorsement. "Tektolo" is our name and not a license to use it.
Your outputs. You may use the estimates, spreadsheets and other outputs the Service generates for you freely, including commercially, subject to Section 3. Attribution to Tektolo is appreciated but not required.
Your inputs. You keep whatever rights you have in what you submit. You grant us permission to process it to run the Service and to keep the anonymized records described in the Privacy Policy.
8. No warranty
The Service is provided "as is" and "as available", experimental, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, availability, and non-infringement. We do not promise the Service will be uninterrupted, error-free or that rules and prices are current.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, repair or vendor costs, deposit disputes or tenant claims arising from use of the Service. Our total liability for any claim relating to the Service is limited to US $100. Because the Service is free, this limit reflects that. Some places do not allow certain limits, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
10. Indemnity
If your misuse of the Service, your breach of these terms, or your violation of law leads to a third-party claim against us, you agree to cover our reasonable costs of defending that claim to the extent the claim arises from your conduct. This does not apply to claims caused by our own wrongdoing.
11. Changes and termination
We may change, suspend or end the Service or any feature at any time, and may block access for misuse. We may update these terms; the effective date above will change, and continued use after an update means you accept it. For material changes we will make a reasonable effort to give notice on the site. You may stop using the Service at any time. Sections that by their nature should survive (disclaimers, liability, indemnity, governing law) survive.
12. Governing law and disputes
These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law rules. Courts in North Carolina have exclusive jurisdiction over disputes, and you consent to them, except that either party may seek relief in any court for intellectual-property misuse. Before filing a claim, please contact us and give us 30 days to try to resolve it informally.
13. General
These terms, with the Privacy Policy and disclaimer, are the whole agreement about the Service. If a provision is unenforceable, the rest stays in force. Not enforcing a term is not a waiver. You may not assign these terms without our consent; we may assign them with the Service.
